Will: From a legal standpoint, the Oliver case will have no bearing on this case, because the court's ruling against the "no agent" rule was thrown out as part of the settlement this fall.

Andy: It's anyone's guess how this will affect Paxton's 2010 season. My feeling is Paxton's best chance to pitch this year would be to drop this whole thing and face whatever suspension the NCAA hands down for his violation of the no agent rule -- he would have to hope it would be similar to what Jeremy Sowers got several years back (just a handful of games). If he tries to fight this, it's probably going to get bogged down in court and he could wind up losing this whole spring season. From everything I understand about Paxton, he's just a good, quiet guy who doesn't want to be at the center of all this -- he just wants to play baseball. Now, I should mention that nobody has actually come out and said that Paxton has violated the "no agent" rule and is in line for a suspension, but if we're being realistic here, that's where this thing is headed.

What are the chances of Paxton pitching for the Wildcats this year? Any idea when a final answer willl be announced? I know it's early, but just looking to hear an opinion.

The NCAA is unbelieveable. Coming from a former Division I assistant baseball coach, it keeps getting worse and worse. When it comes to that amount of money, that you should be able to have legal counsel available to you. In any profession, if you are offered a job worth over $1 million, you will not sign that contract until your attorney/manager/agent has looked over it and OK'd everything (assuming you're smart). The NCAA doesn't allow that opportunity, but is very quick to exploit its athletes in everything from bowl games to the College World Series, in which the NCAA makes more money than it should...ironic, huh?

How will the ruling in Andy Oliver's case and the possible outcomes of this confrontation mesh? What are the ramifications on agents and players as far as having to negotiate on their own?

The NCAA is arrogant beyond belief. What/who are they protecting? The Universities? The athletes? How can ANYONE not see the unfairness in expecting 20-21 yr old "kids" to negotiate million dollar deals against experienced, veteran legal minds. MLB...or the NCAA would never allow a 24 yr old, 1st yr out of law school, be the decision maker on this type of deal...why expect the players. Because they are giving a 5-10000 per year scholarship? Get real NCAA.
